DMCA Policy
Overview
MitsuHub complies with the provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512) and responds promptly to notices of alleged copyright infringement. If you believe that your copyrighted work has been copied and made accessible on MitsuHub in a way that constitutes copyright infringement, you may submit a takedown notice to our designated agent.
This policy applies to all user-generated content on MitsuHub, including but not limited to:
- Community posts and comments
- User-uploaded images (profile pictures, banners, post attachments)
- Watchlist descriptions and content
- User-created lists and reviews
- Any other content uploaded or shared by users on the platform
Takedown Process
Here's how our DMCA takedown process works:
Submit a Notice
The copyright owner (or authorized agent) sends a complete DMCA takedown notice to our designated agent with all required information.
We Review & Act
Upon receiving a valid notice, we will promptly review the claim and remove or disable access to the allegedly infringing material.
User Notification
We will notify the user who posted the content about the takedown and provide them with a copy of the notice.
Counter-Notification (Optional)
If the user believes the content was removed in error, they may submit a counter-notification. If valid, the content may be restored after 10-14 business days.
Filing a DMCA Takedown Notice
To file a DMCA takedown notice, you must provide the following information in writing to our designated agent:
- A physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are involved)
- Identification of the infringing material on MitsuHub, including the specific URL(s) or sufficient information for us to locate the content
- Your contact information, including name, address, telephone number, and email address
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
Counter-Notification
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, and that you will accept service of process from the person who filed the original DMCA notice
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action seeking a restraining order within 10-14 business days, we may restore the removed content.
Repeat Infringers
In accordance with the DMCA, MitsuHub maintains a policy of terminating the accounts of users who are determined to be repeat infringers in appropriate circumstances. A "repeat infringer" is a user who has been the subject of more than two valid DMCA takedown notices.
Our repeat infringer policy includes:
- First offense: Content removal and formal warning sent to the user
- Second offense: Content removal, warning, and temporary restriction on uploading content
- Third offense: Account termination at our discretion
We reserve the right to terminate any account at any time for copyright infringement, even on the first offense if the circumstances warrant it.
Good Faith & Fair Use
We encourage all parties to consider whether the use of copyrighted material qualifies as "fair use" under copyright law before filing a takedown notice. Fair use may include uses for purposes such as criticism, commentary, news reporting, teaching, scholarship, and research.
MitsuHub is not in a position to adjudicate copyright disputes between parties. We follow the DMCA procedures as required by law and encourage parties to seek legal counsel if there is a dispute about whether content constitutes infringement.
We act in good faith in processing all DMCA notices and counter-notifications, and we strive to treat all parties fairly throughout the process.
Designated Agent
All DMCA notices and counter-notifications should be sent to our designated agent:
- Support page: mitsuhub.com/support, selecting the "Content / DMCA" category
- Subject: DMCA Takedown Notice, or DMCA Counter-Notification
We aim to process valid notices within 48 to 72 hours of receipt. If the matter is urgent, say so in the first line of your notice.
